Terms of Service
1. What Karera Is
Karera provides QR-based Keepsake Memory Cards sold through participating retail vendors. Each card allows a sender to create a private digital album — including photos, a short video, and a personal message — that a recipient can access by scanning the QR code. No app or account is required.
2. Hosting Duration
Albums are hosted for two (2) years from the date the card is activated. Before this period ends, the sender may be notified and given the option to download their content. After the hosting period expires, the album and all associated media may be permanently removed. Karera does not guarantee indefinite or lifetime hosting. Extension options may be offered at Karera's discretion.
3. Content Responsibility
The sender (the person who uploads content to a memory card) is solely responsible for all photos, video, and text they upload. By uploading content, the sender confirms they have the right to use and share that content and that it does not violate any laws, infringe on third-party rights, or contain abusive, hateful, or illegal material.
4. Abusive Content
Karera reserves the right to disable or remove any album that is reported as containing abusive, harmful, illegal, or otherwise objectionable content. Karera may investigate reports and take action at its discretion, including permanently disabling the associated QR card.
5. Vendor Agreement
Participating vendors agree to the following terms when activating and selling Karera Keepsake Memory Cards:
- Cards must be activated only at the point of sale. Each activation incurs a fee of $7.00 CAD per card, added to the vendor's billing balance.
- Billing is triggered at the moment of activation, regardless of whether the customer subsequently creates an album. Once activated, the charge applies.
- Vendors are billed on a weekly cycle during the pilot phase. Monthly billing may be offered to established vendors at Karera's discretion.
- Vendors cannot reverse or void activations on their own. Mistaken activations must be reported to KareraOS support (see Section 6).
- If a vendor account is suspended due to non-payment, any existing completed customer albums will remain active and accessible to recipients. Customer content is never penalized for vendor billing issues.
- Vendor accounts may be paused from activating new cards if there is an outstanding payment issue, until the balance is resolved.
6. Refund, Void & Credit Policy
KareraOS provides the following mechanisms for addressing billing adjustments related to card activations:
- Void — Used before an invoice or payment has been collected, typically for mistaken activations. If a card was activated in error and the customer has not yet claimed or started an album, vendors may request a void within a 14-day grace period. A KareraOS administrator will reset the card and remove the $7.00 charge from the vendor's balance.
- Refund — Used after payment has been collected. Refunds are handled on a case-by-case basis and must be requested through [email protected].
- Credit — A billing credit may be applied to a vendor's future balance at Karera's discretion, such as in cases of service disruption or goodwill adjustments.
If a card has already been claimed by a customer or an album is in progress, automatic voids are not available. These cases are handled as manual support requests.
7. Pricing & Fees
- Vendor activation fee: $7.00 CAD per activated card.
- Taxes: Applicable taxes (GST/HST) are calculated based on the vendor's location and added to invoices.
- A billing summary is displayed at the point of activation before the vendor confirms. There are no hidden platform fees or monthly minimums.
Customers (senders and recipients) are not charged by Karera. The physical card is purchased from the vendor at the vendor's retail price.
8. Upload & Service Limits
Each Karera Keepsake Memory Card album is subject to the following limits:
- Photos: Up to 30 photos per album. Maximum 20 MB per photo. Accepted formats: JPEG, PNG, HEIC.
- Video: 1 video per album. Maximum 50 MB. Accepted formats: MP4, MOV, WebM.
- Edit window: After an album is marked as complete, the sender has a 7-day edit window to make changes. After this window closes, the album is locked and can only be modified through support.
- Hosting period: 2 years from the card's activation date (see Section 2).
Karera reserves the right to adjust these limits. Any changes will be reflected on this page and at the point of upload.
9. Limitation of Liability
Karera is provided “as is” without warranties of any kind. Karera is not liable for lost content, service interruptions, or any indirect damages arising from the use of the platform. Use of Karera constitutes acceptance of these terms.
Privacy Policy
1. Album Privacy
Albums are private. They are not indexed by search engines and are not publicly listed anywhere. However, anyone with the QR code or direct link can access the album. If a sender enables the optional passcode, the album requires a PIN to view.
2. Optional Passcode
Senders may choose to protect their album with a 4-digit passcode. This is optional. If no passcode is set, anyone who scans the QR code or follows the link can view the album. Karera recommends setting a passcode for sensitive content.
3. Vendor Access Restrictions
Vendors cannot view the private content of any album. Vendors can only see card status, activation dates, and album completion status — never the uploaded photos, video, or personal message. This privacy boundary is enforced at the system level.
4. Data We Collect
We collect the minimum data needed to operate the service: the sender's email address (for the edit link), phone number (if provided), uploaded media (photos, video, and personal message), scan analytics (device type, timestamp), and vendor account information. We do not sell personal data to third parties.
5. Data Retention
Album content (photos, video, and personal messages) is retained for the hosting period of two (2) years from card activation. After the hosting period expires, all album content is permanently deleted from our servers.
Vendor account data is retained for the duration of the vendor relationship plus any legally required retention period. Scan analytics and billing records may be retained for up to 7 years for tax and accounting purposes.
6. Your Data Rights
Under Canada's Personal Information Protection and Electronic Documents Act (PIPEDA), you have the right to:
- Request access to the personal data we hold about you.
- Request correction of inaccurate personal data.
- Request deletion of your personal data.
To submit a data request, contact us at [email protected]. We will respond within 30 days.
Please note that if you request deletion of album content before the hosting period ends, the recipient will also lose access to the album.
7. Email Communications & Consent
Karera sends transactional emails only, directly related to the service you requested:
- Edit link delivery after album completion.
- PIN lockout security notifications.
- Vendor billing and account notifications.
These communications are exempt from consent requirements under Canada's Anti-Spam Legislation (CASL) as they are directly related to the service being provided. Karera does not send marketing or promotional emails without your explicit opt-in consent.
8. Privacy Breach Notification
In the event of a data breach involving personal information that poses a real risk of significant harm, Karera will:
- Notify affected individuals as soon as feasible after determining that a breach has occurred.
- Report the breach to the Office of the Privacy Commissioner of Canada as required under PIPEDA.
- Include in the notification: the nature of the breach, the types of personal data affected, steps Karera has taken to mitigate harm, and recommended actions for affected individuals.
9. Governing Law
These terms are governed by and construed in accordance with the laws of the Province of Ontario and the applicable federal laws of Canada. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of the Province of Ontario.
